Premises Licence Review
The Licensing Act 2003 incorporates procedures to review a Premises Licence, where the licensing objectives are not being promoted. Residential and business occupiers near to licensed premises can apply to review a licence at any time. The police and other authorities can also apply for a review – this could result in reduction in trading hours, new conditions being imposed, or revocation of the licence in extreme cases. Reviews often follow failed test purchase exercises by trading standards and/or the police.Summary or expedited reviews are more serious matters – where the police have evidence that licensed premises are associated with serious crime or serious disorder, they can apply to the Council for a summary review of a licence. This results in a hearing within 48 hours, which can lead to suspension of a licence pending a full review. Summary reviews should not be ignored as they can result in a business having to close down – we can help avoid suspension in these situations.
